In 1957, the Treaty of Rome established the continent’s first customs union, a clear effort to eliminate trade barriers between countries and promote economic growth.
The Customs of the six founding Member States of the European Economic Union (EEC) France, Germany, Italy, Belgium, Luxembourg, Netherlands had already been harmonised to such a degree that the customs payable by third countries could be established on the basis of a common customs tariff.
Since it was no longer possible to levy customs duties on goods traded between Member States, there existed a customs tariff union between the founding Member States of the modern European Community long before the creation of the European internal market.
In 1986 The European Single Act (SEA) adopted this framework in its approach to establishing the single market.
In 1992 The Treaty of the European Union (TEU), also known as Treaty of Maastricht in Article 2 (The Community shall have as its task, by establishing a common market and an economic and monetary union).
Since 1 January 1994 (Art. 1 sentence 1 Customs Code), this Customs Code has been the general customs law in the EC and is uniformly applicable in all Member States. Decades of effort marked by the issue of many hundreds of pieces of legislation aimed at harmonising customs law proved successful. Being a Regulation, the CC is legally binding in all Member States (Art. 249 EC).
Throughout the Community, it takes precedence over any confl icting national law, which now only performs a complementary function. |

The European Community's (EC) founding Treaties define the core elements of the Customs Union. Article 23 of the EC Treaty emphasises that the Customs Union covers all trade in goods.
Customs Union involves the prohibition, between Member States, of customs duties on imports and exports and of all other charges with equivalent effect. It also involves adopting a Common Customs Tariff (CCT), an external tariff on goods imported from third countries. The Member States thereby agreed to merge their different customs tariffs into a single tariff applicable throughout the EC.
In Articles 25 to 27, the EC Treaty sets out further provisions relating to the Customs Union and to the prohibition of quantitative restrictions between Member States. The Community forms a single territory, without internal borders, within which the free movement of goods is guaranteed.
The customs policy is the responsibility of the Community and is implemented by the Member States. The Member States are responsible, in particular, for cracking down on infringements of customs legislation. The national customs administrations are charged with implementing EU legislation on a day-to-day basis: levying customs duties and applying various measures and formalities to imported products. |

CHAPTER (1)
THE CUSTOMS UNION |
Customs duties on imports and exports and charges having equivalent effect shall be prohibited between Member States. This prohibition shall also apply to customs duties of a fiscal nature. |

Common Customs Tariff duties shall be fixed by the Council acting by a qualified majority on a proposal from the Commission. |

(d) The need to avoid serious disturbances in the economies of Member States and to ensure rational development of production and an expansion of consumption within the Community.

The role and importance of the free movement of goods in the single market The European Single Market is the world largest domestic market. It has contributed significantly to growth, competitiveness and employment.
Since the entry into force of the EC Treaty, one of the fundamental aims of completing the internal marke t has been the abolition of quantitative restrictions and measures having equivalent effect which constitute barriers to trade within the EU, as laid down by Articles 28 : 30of the Treaty which normally establishes the principle of the free movement of goods.
The free movement of goods is a cornerstone of the Single Market and the European Commission is vigilant in ensuring the free movement provisions, as contained in the Treaty, are upheld, most significantly, by investigating alleged infringements of the provisions by Member States.
In European Union law, the Four Freedoms is a common term for a set of Treaty provisions, secondary legislation and court decisions, protecting the ability of Goods, Services, Capital, and Labour to move freely within the Internal Market of the European Union. More precisely, they are:
- The free movement of goods.
- The free movement of services and freedom of establishment.
- The free movement of persons (and citizenship), including free movement of workers.
- The free movement of capital.

Nine titles and 253 articles of the CC only contain the basic Provisions of European customs law.
- The Regulation (EEC) No 2454/93of laying down provisions for the implementation of Council Regulation (EEC) No 2913/92 contains the details are found in the 915 articles of the Regulation Implementing the CC and its 113 annexes .
- Its provisions are systematically related to the CC, and the only way of ensuring that the CCIP fully reflects the economic situation is through constant revision, which takes place at the middle and end of each year.
After all the CCIP reflect the practical environment of customs. |

Article 5a(2), Article 13(2) 2nd subparagraph, Article 36a(4), Article 36b(1), Article 182a(2) and Article 182d(1) shall be applicable from 11 May 2005.
All other provisions shall be applicable once the implementing provisions on the basis of the Articles referred to in the second subparagraph have entered into force. However, electronic declaration and automated systems for the implementation of risk management and for the electronic exchange of data between customs offices of entry, import, export and exit, as stipulated in Articles 13, 36a, 36b, 36c, 182b, 182c and 182d, shall be in place three years after these Articles have become applicable.

- Points 1 to 30 and 32 to 38 of Article 1 shall apply from 1 July 2001.
- Each authorisation granting the status of authorised consignee shall comply with Article 408a of Regulation (EEC) No 2454/93 by a date decided by the customs authorities, and at the latest by 31 March 2004.

- This Regulation shall enter into force on the seventh day following its publication in the Official Journal of the European Communities.
- Points 21 and 22 of Article 1 shall apply with effect from 1 July 2001.

The provisions referred to in the first subparagraph shall not apply to Community transit operations for which the transit declaration has been presented before 1 April 2002.

Commission Regulation (EC) No 881/2003 of 21 May 2003 amending Regulation (EEC) No 2454/93 laying down provisions for the implementation of Council Regulation (EEC) No 2913/92 establishing the Community Customs Code.
The Commission shall, before 1 July 2004, evaluate the degree of implementation of the computerised transit system by traders. That evaluation shall be based on a report drawn up from information contributed by the Member States.
This Regulation shall enter into force on the third day following that of its publication in the Official Journal of the European Union.

Points (2) and (3) of Article 1 shall apply from 1 June 2003. Proofs of origin issued in accordance with the provisions applicable before 1 June 2003 shall continue to be accepted after that date within the limits of their validity.

Points (10), (11), (30), (32) and (33) of Article 1 shall apply from 1 January 2005. However, on the basis of the evaluation provided for in Article 2, that date may be deferred by decision adopted in accordance with the committee procedure.

Points (12) to (21) of Article 1 shall apply from 1 September 2003. 5. Point (29) of Article 1 shall apply from 1 May 2004.

Commission Regulation (EC) No 2286/2003 of 18 December 2003 amending Regulation (EEC) No 2454/93 laying down provisions for the implementation of Council Regulation (EEC) No 2913/92 establishing the Community Customs Code.
Before 1 January 2005, the Commission shall evaluate Member States' plans for implementation of the measures provided for in Article 1(3) to (9), (17) and (18). That evaluation shall be based on a report drawn up from contributions of the Member States.
- This Regulation shall enter into force on the day following that of its publication in the Official Journal of the European Union.
- Article 1(11) and (12) shall apply with effect from 1 January 2004.
- Article 1(1), (2), (15) and (16) shall apply with effect from 1 February 2004.
- Article 1(3) to (9), (17) and (18) of shall apply with effect from 1 January 2006. However, Member States may implement them before that date. In such cases, Member States shall notify the Commission of the date on which they implement the provisions of this Regulation.
- The Commission shall publish that information.
- The Commission may decide, on the basis of the evaluation provided for in Article 2 and in accordance with the committee procedure, whether and subject to what conditions a deferral of the date specified in the first subparagraph is necessary.
- The Commission shall publish that information.

This Regulation shall be binding in its entirety and directly applicable in all Member States.

Council Regulation (EC) No 837/2005 of 23 May 2005 amending Commission Regulation (EEC) No 2454/93 laying down provisions for the implementation of Council Regulation (EEC) No 2913/92 establishing the Community Customs Code.
This Regulation shall enter into force on the twentieth day following that of its publication in the Official Journal of the European Union.
It shall apply from 1 July 2006. However, the customs authorities may continue to accept transit declarations made in writing until 31 December 2006 at the latest. Where the customs authorities decide to accept transit declarations made in writing after 1 July 2005, the decision shall be communicated to the Commission in writing before 1 July 2005.
In this case the customs authorities of these Member States shall ensure that the transit data is exchanged between the customs authorities using information technology and computer networks. This Regulation shall be binding in its entirety and directly applicable in all Member States.

Commission Regulation (EC) No 883/2005 of 10 June 2005 amending Regulation (EEC) No 2454/93 laying down provisions for the implementation of Council Regulation (EEC) No 2913/92 establishing the Community Customs Code.
- This Regulation shall enter into force on the third day following its publication in the Official Journal of the European Union.
- Points 1 to 8, 17 to 20, 24, 28 and 30 of Article 1 shall apply with effect from 1 May 2004.
- Points 9 to 15, 31, 32 and 33 of Article 1 shall apply with effect from 1 October 2005.
- Points 23, 25 and 26 of Article 1 shall apply with effect from 1 July 2005.
- Points 22, 27 and 29 of Article 1 shall apply with effect from 1 January 2006. However, the Member States may apply those points before that date. In such cases, the Member States shall notify the Commission of the date of application. The Commission shall publish this information. Commission Regulation (EC) No 215/2006 of 8 February 2006 amending Regulation (EEC) No 2454/93 laying down provisions for the implementation of Council Regulation (EEC) No 2913/92 establishing the Community Customs Code and amending Regulation (EC) No 2286/2003
Article 3(4) of Regulation (EC) No 2286/2003 is replaced by the following: "4. Article 1(3) to (9), (17) and (18) shall apply from 1 January 2006.
However, Member States may implement these provisions before that date. In addition, Member States having difficulty adapting their customs clearance computer systems may defer the adaptation of these systems until 1 January 2007. In such cases, Member States shall notify the Commission of the method by which and the date on which they implement Article 1(3) to (9), (17) and (18). The Commission shall publish that information."
- This Regulation shall enter into force on the day of its publication in the Official Journal of the European Union.
- Article 1(1) to (4) shall apply from 19 May 2006.
- Article 1(5) and Article 2 shall apply from 1 January 2006. This Regulation shall be binding in its entirety and directly applicable in all Member States.

Commission Regulation (EC) No 402/2006 of 8 March 2006 amending Regulation (EEC) No 2454/93 laying down provisions for the implementation of Council Regulation (EEC) No 2913/92 establishing the Community Customs Code.
This Regulation shall enter into force on the seventh day following its publication in the Official Journal of the European Union.
However, points 4, 7 and 8 of Article 1 shall apply from 1 June 2006. This Regulation shall be binding in its entirety and directly applicable in all Member States.

This Regulation shall enter into force subject to, and on the date of the entry into force of the Treaty of Accession of Bulgaria and Romania.

Commission Regulation (EC) No 1875/2006 of 18 December 2006 amending Regulation (EEC) No 2454/93 laying down provisions for the implementation of Council Regulation (EEC) No 2913/92 establishing the Community Customs Code.
During a transitional period of 24 months starting from 1 January 2008, the period for issuing the AEO certificate referred to in the first sentence of Article 14o(2) shall be extended to 300 calendar days, the period for communication of the application referred to in Article 14l(1) shall be extended to 10 working days, the period for information referred to in Article 14l(2) shall be extended to 70 calendar days, and the period for consultation referred to in Article 14m(1) shall be extended to 120 calendar days.
- This Regulation shall enter into force on the seventh day following that of its publication in the Official Journal of the European Union.
- Point (3), except insofar as it relates to paragraphs 2 and 3 of Article 14b, and points (23), (25), (28), (41), (44), (45), (70) and (71) of Article 1 shall apply from 1 January 2008.
- Point (3), insofar as it relates to paragraphs 2 and 3 of Article 14b, and points (4) to (16), (18), (19), (21), (22), (24), (26), (27), (29), (30), (32), (33), (36), (39), (46) to (49), (55), (59), (60), (63), (65) to (68), (72) of Article 1 shall apply from 1 July 2009.
This Regulation shall be binding in its entirety and directly applicable in all Member States.
